On Tuesday, Florida US District Judge Aileen Cannon decisively rejected a plea from the prosecution that sought to impose restrictions on Trump’s public declarations, particularly those that might pose risks to the safety of law enforcement personnel engaged in the case.
The basis for the court’s decision, as articulated by Judge Cannon, was that the prosecution had not afforded the defense adequate opportunity to review and discuss the gag order proposal before its submission late Friday evening.
Thus, Judge Cannon dismissed the prosecution’s request without prejudice—a legal term that allows for the possibility that the issue could be brought before the court again should circumstances warrant.
Adding complexity to the legal skirmish, Special Counsel Jack Smith underscored the necessity of the prosecutorial request.
He pointed to a series of what he characterized as “intentionally false and inflammatory statements” made by Trump.
These statements pertained to the Federal Bureau of Investigation’s (FBI) search of Trump’s Mar-a-Lago golf resort in Florida in August 2022.
Smith described Trump’s allegations as stark and provocative.
Trump said the FBI agents who searched his estate were “authorized to shoot me” and were “locked & loaded ready to take me out & put my family in danger.”
These remarks by the former president relate to a detail revealed in a court document.
It indicated that during the FBI’s search of Mar-a-Lago, the agents were guided by a standard use-of-force policy.
This policy restricts the employment of deadly force solely to circumstances where there is a reasonable belief that the “subject of such force poses an imminent danger of death or serious physical injury to the officer or to another person.”
