Despite being charged with aggravated forcible rape of a child, Hernandez-Rodas was released under local policy, ignoring ICE detainers.
The 2017 Massachusetts court ruling rejected ICE detainers, aiming to resist “anti-immigrant policies.”
However, many argue this measure leaves communities vulnerable to crime. Massachusetts GOP advocates for legislative action to mandate compliance with ICE detainers, citing risks to public welfare.
ICE’s Enforcement and Removal Operations (ERO) echoes this concern, with numerous arrests of illegal immigrants suspected of violent crimes across Massachusetts.
Recent operations in Nantucket highlighted instances where released individuals posed threats to community safety.
“Instances of illegal immigrants being charged with heinous crimes, arrested, and released because ICE detainers are ignored under our state’s sanctuary philosophy have become far too common,” says Amy Carnevale, Massachusetts Republican Party Chair, cited by Newsweek.
Governor Maura Healey, a firm defender of Massachusetts’ sanctuary status, remains opposed to excessive federal intervention.
Her administration maintains that sanctuary policies are essential for immigrant community trust, despite criticism from federal authorities and local law enforcement.
Several high-profile cases, including that of Colombian national Mateo Hincapie Cardona, underscore conflicted immigration enforcement efforts’ challenges.
Cardona, previously arrested by Boston police for child exploitation, was released after local authorities ignored an ICE detainer.
“This individual is charged with committing heinous crimes against a child, which show him to be a distinct threat to our Massachusetts community,” said ERO Boston acting Field Office Director Patricia H. Hyde.
