(TheLastPatriotNews.com) – In a new blow to Republican efforts to defend the Southern Border against the ongoing illegal alien invasion, a federal judge ordered Texas to dismantle the floating barriers it recently erected in the Rio Grande.
On Thursday, US District Court Judge David Ezra of the Western District of Texas told the state to remove the anti-illegal immigration hurdles only built in July.
Texas Republican Governor Greg Abbott reacted shortly by announcing that the state would appeal the ruling to the 5th Circuit Court of Appeals, Breitbart News reports.
“Today’s court decision merely prolongs President Biden’s willful refusal to acknowledge that Texas is rightfully stepping up to do the job that he should have been doing all along,” Abbott declared in a statement issued by his office.
“This ruling is incorrect and will be overturned on appeal,” he added.
Judge Ezra, who ordered the removal of the Rio Grande barriers, was first appointed by President Ronald Reagan to the District of Hawaii. US Supreme Court Chief Justice John Roberts reassigned him to the Western District of Texas.
In his order, the judge emphasized Governor Abbott’s words that he was not “asking for permission” to put up the floating anti-migrant barriers.
“Unfortunately for Texas, permission is exactly what federal law requires before installing obstructions in the nation’s navigable waters,” Ezra argued.
He noted that Mexico’s president had complained about the barriers and disputed the governor’s comments that America was facing an “invasion.”
“And all Texas’s new argument does is ask the Court… [to sanction] Texas’s assertion of plenary power to declare and respond to ‘all types of invasions, including invasions from non-state or quasistate actors.’ Under this logic, once Texas decides, in its sole discretion, that it has been invaded, it is subject to no oversight of its ‘chosen means of waging war.’ Such a claim is breathtaking,” the judge asserted.
Abbott replied that his administration would be relentless in its efforts to secure the border.
“Our battle to defend Texas’ sovereign authority to protect lives from the chaos caused by President Biden’s open border policies has only begun. Texas is prepared to take this fight all the way to the US Supreme Court,” the governor said.
