ATF’s New Attack on Gun Rights

(TheLastPatriotNews.com) – The left clearly won’t rest until they’ve robbed Americans of their Second Amendment rights, as evidenced by a new measure that the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has come up with to practically ban gun sales between private persons, reports reveal.

The new repressive measure under development by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) was disclosed by whistleblowers within the agency to Empower Oversight, a bipartisan watchdog group.

This group, also involved with one of the Hunter Biden Internal Revenue Service whistleblowers, was informed that the ATF is preparing a 1,300-page proposal, The Daily Caller reports.

The proposal would necessitate background checks for all gun sales, encompassing those between private parties.

Empower Oversight issued a press release stating that this rule would “effectively ban private sales of firearms from one citizen to another.”

Empower Oversight has requested records from the Department of Justice to seek further details regarding this rule.

“[The rule would] violate the Second Amendment to the United States Constitution… [and] circumvent the separation of powers in the Constitution,” reacted Tristan Leavitt, the president of Empower Oversight.

The proposed ATF rule could potentially redefine the scope of what constitutes being “engaged in the business of dealing in firearms.”

Thus, even those who sell guns occasionally might need to obtain a Federal Firearms License and conduct background checks on buyers.

This contrasts with the definition set by the Firearms Owners Protection Act of 1986, which specifies that the term “shall not include a person who makes occasional sales, exchanges, or purchases of firearms for the enhancement of a personal collection or for a hobby.”

Leavitt opined that this rule would likely be invalidated by the courts and suggested that it might be a strategy to energize the Democratic voter base during an election period.

Polling data indicates that the electorate generally favors private background checks, The Caller notes.

A 2022 Morning Consult and Politico survey showed that 81% of registered voters supported background checks at gun shows and private transfers.

However, support for such checks varies along party lines, with a 2021 poll indicating higher support among Democrats (77%) compared to Republicans (53%).

Gallup reported that only 27% of Americans favored banning handgun ownership as of October 2023.

A Monmouth University poll in April 2023 revealed that more Americans opposed an “assault weapons” ban than supported it.
